These Terms of Service ("Terms") govern your use of backyardsolstice.com and purchases from Backyard Solstice, operated by Backyard Solstice, LLC ("Backyard Solstice," "we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms and our posted policies.

1. ELIGIBILITY AND ACCEPTABLE USE

You must be able to enter a legally binding agreement to use the Site or purchase products. You may not use the Site for unlawful, fraudulent, abusive, or unauthorized purposes; interfere with its operation; introduce malicious code; scrape or copy content in violation of law; or infringe another person's rights.

2. PRODUCT INFORMATION

We work to present accurate descriptions, specifications, colors, images, dimensions, materials, compatibility information, assembly disclosures, and availability. Screen settings, photography, manufacturing variation, natural materials, and supplier updates can affect appearance or details. Product information may be corrected when an error is discovered.

3. PRICING AND ORDERS

Prices are shown in U.S. dollars unless stated otherwise. Taxes, shipping, and other applicable charges are shown at checkout or communicated as required. We may decline, cancel, limit, or place an order on hold because of pricing or description errors, inventory changes, shipping restrictions, suspected fraud, payment issues, supplier limitations, or other reasonable business concerns. If we cancel a paid order, we will refund the canceled amount.

4. PAYMENT

You represent that the payment and billing information you provide is accurate and that you are authorized to use the payment method. Payment processing is provided by third parties and may be subject to their terms. A payment authorization or order confirmation does not mean the order has shipped.

5. SHIPPING AND DELIVERY

Shipping is governed by our Shipping Policy. Delivery and processing estimates are not guarantees. Large items may arrive by curbside freight delivery. Unless expressly included in writing, delivery does not include placement, unpacking, assembly, installation, pool setup, utility connection, or packaging removal.

6. INSPECTION, DAMAGE, AND CLAIMS

Inspect deliveries promptly, document visible damage on the carrier receipt, retain packaging, and contact us with photographs and order details as soon as possible. Do not discard, install, alter, or refuse damaged merchandise unless instructed. Available remedies depend on the facts, applicable law, supplier requirements, and carrier procedures.

7. RETURNS, CANCELLATIONS, AND REFUNDS

Returns, cancellations, and refunds are governed by our Return and Refund Policy and any product-specific terms disclosed before purchase. Certain custom, made-to-order, final-sale, opened, assembled, installed, or used products may be restricted from return where permitted by law.

8. ASSEMBLY, INSTALLATION, AND PRODUCT USE

You are responsible for reviewing product instructions, dimensions, site conditions, compatibility, weight limits, water-depth requirements, safety information, and applicable codes before use or installation. Assembly or professional installation may be required. Do not use a product in water, near fire, with utilities, or for another specialized purpose unless the manufacturer expressly approves that use.
